In booking your Birthday Experience from Birthday Reserve, you agree to be bound by the Terms of Sale (“Terms”) effective at the time of your purchase including our Privacy Policy and Terms of Service which are incorporated in these Terms by reference. Should you not agree to all of these Terms, do not make any bookings from Birthday Reserve or utilize our Services. Your booking through our website is governed by these Terms.
We reserve the right to change or modify these Terms at any time in our sole discretion. Should we make changes to these Terms, notice may be provided through sending you a notification, providing notice through the Services, or by updating the “Last Updated” date at the top of these Terms. Review these Terms each time you make a purchase from Birthday Reserve to ensure that you understand the Terms applicable to your booking.

11. Birthday Experience
From time to time we may offer other special promotions intended to provide you an incentive to book a Birthday Experience and/or to encourage you to get others to do so. The applicable rules will be posted on the Birthday Reserve site in or near the description of each such promotion. We reserve the right to interpret these rules in our sole discretion and to cancel any promotions without notice.
The Birthday Experience is valid for the period outlined in the terms and conditions for each package. Additional terms and conditions may apply, as specified by the retailer. Please be present on the selected date. Birthday Reserve is not responsible for bookings that are not used within the timeframe outlined in the terms and conditions. Unless otherwise required by law, Birthday Experiences are not redeemable for cash.
Birthday Reserve will not refund your Birthday Experience if it is not used. Please turn up for your Birthday Experience.
12. Retailer Terms and Liability
Birthday Experiences that you purchase through our Services are issued by participating third-party retailers (“Retailers”). Your purchase of each Birthday Experience is governed by certain terms and conditions established by the issuing Retailer in addition to these Terms. Retailers may set expiration dates for Birthday Experience in addition to other restrictions and requirements. Please review all applicable Retailers’ terms and conditions prior to the purchase of any Booking Experience. If you have questions relating to the applicable Retailer terms, please contact the issuing Retailer.
As the issuers of Birthday Experience, Retailers (and not Birthday Reserve) are fully responsible for all aspects of their Birthday Experience programs. Retailers are responsible for all liabilities and costs suffered by you or any other party caused – directly or indirectly – by the Retailer or their products or services.
We have no obligation to resolve any dispute between you and any Retailer. Birthday Reserve endeavours to work with reputable Retailers, however Birthday Reserve holds no liability for the sale of products or services provided to you by a Retailer.
In purchasing a Birthday Experience from an issuing Retailer, you waive and release Birthday Reserve and its subsidiaries, affiliates, partners, officers, directors, employees and agents from any liabilities arising from or related to any act or omission of a Retailer. Following the booking of a Birthday Experience, Birthday Reserve shall not be responsible or liable to you in the event a Retailer discontinues its Birthday Experience or is unable to or refuses to redeem your Birthday Experience (including for reasons of their insolvency, external administration or forced closure).
13. Payment Options
Accepted forms of payment are debit and credit cards approved by Birthday Reserve, for example Visa and MasterCard. Birthday Reserve, reserves the right to make changes to the payment methods available for use without notice. Birthday Experience may not be purchased with cash. Unless indicated otherwise, the booking of a Birthday Experience will be fully billed at the time the Experience is booked by you. Birthday Reserve uses a third-party PCI compliant payment processor and we do not hold any financial information. If your payment cannot be verified, is invalid or otherwise unacceptable, your order may be suspended or cancelled automatically. Any problems encountered in the processing of your order are not the responsibility of Birthday Reserve.
14. Birthday Experience Activation
All Birthday Experiences sold via our Services are valid on the date selected at booking. They are also subject to each Retailer’s own terms and conditions regarding activations.
15. Cancellations; Returns
Please choose your Birthday Experience carefully as we do not allow exchanges or offer refunds on Birthday Experiences.
Birthday Reserve is not responsible for the refund of the purchase price or return of any products purchased from Retailers.
16. Your Birthday Experience, your responsibility
Birthday Reserve attempts to be as accurate as possible in providing Services, however sometimes errors may occur. We do not represent or warrant that any description, Booking Experience, Retailer or pricing information displayed on our Service is accurate, complete, reliable, current or error-free. In the event of an error caused by us, we will attempt to correct it as quickly as possible and revise your order accordingly.
17. Excluded Users and Territories
You are not permitted to purchase products or services from Birthday Reserve if you are:
